LAW301: Legal Theory

This unit will trace the classical origins of the rule of law, survey the historical events that influenced the development of theories of law, and evaluate the contributions of legal theorists. Topics will include natural law, positivism, liberalism, Marxist legal theory, economic legal theory, customary law, international law and Islamic jurisprudence. This unit aims to provide students with an understanding of the 'philosophy of law' and equip students with knowledge of the historical context in which law has developed.

Prerequisites

L120/LEG120/LAW120 Research and Writing, L150/LEG150/LAW150 Australian Legal System, L152/LAW152 Torts, L130/LAW130 Criminal Law and Procedure, L260/LAW260 Contract.

Exclusions

Students who have successfully completed LAW366/L366 Jurisprudence cannot enrol in this unit for credit.
