LAW260: Contract

This unit will consider the elements necessary for the formation of an enforceable contract, including offer and acceptance, consideration, intention, certainty of terms and capacity; the ways in which contractual terms are determined and interpreted; vitiation of otherwise enforceable contracts by elements such as misrepresentation, mistake, illegality or unconscionability; and enforcement of contractual rights, including excused performances, rights to terminate and available remedies for breach.

Lectures: 4 hours per week; tutorials: up to six hours per semester.

Prerequisites

L150/LEG150/LAW150 Australian Legal System.
In addition, students must have passed L120/LEG120/LAW120 Research and Writing, or be concurrently enrolled in LAW120 Research and Writing.
Co-requisites: Juris Doctor students can enrol in both LAW120 and LAW150 as co-requisites.
