Section 3.2 Content

Section 3.2.4 Non-Compliant Content

For the purposes of this Policy, Non-Compliant Content is Content prepared or produced in such a way that it may place the University’s good name or image at risk, or could contribute to a situation of legal liability for the University.

MurdochNet Content should not include Non-Compliant Content.

In detailing the types of material that are considered to be Appropriate Content, Section 3.2.1 refers to Content management practices. These practices include applying standards, following guidelines, complying with legislation, following the Murdoch Conventions for Content Preparation (as listed in Section 5.4), and providing information that is accurate and up-to-date. The Content management practices also include following Murdoch guidelines for Corporate Style, navigation, metadata and archiving.

Content Providers should be aware of the range of legislation to which Content is subject, including, but not limited to the following legislation:

Federal:

Broadcasting Services Amendment (Online Services) Act 1999

Copyright Act 1968

Disability Discrimination Act 1992

Education Services for Overseas Students Act 2000

Privacy Act 1988

Trade Practices Act 1974.

Western Australian:

Electronic Transactions Act 2003

Fair Trading Act 1987

State Records Act 2000.

Content Providers should also be aware that where the University determines that Content is Non-Compliant Content and that it presents an unacceptable risk to the University, then appropriate steps shall be taken to reduce the risk (eg. modification or removal of Content). These steps may include liaison with the respective Web Liaison Officer, Content Custodian, and Web Administrator responsible for the Server hosting the Content.

The University reserves the right to use whatever mechanisms necessary to put in place appropriate access restrictions to Content found to be Non-Compliant and prepared or produced in such a way that it may place the University’s good name at risk, or could contribute to a situation of legal liability for the University.
