Section 5.4 Murdoch Conventions for Content Preparation

Section 5.4.9 Disclaimer Convention

The Murdoch Disclaimer Convention to be practiced in the preparation of Content includes:

  • use of a disclaimer statement
  • including a link to an official disclaimer notice.

Disclaimer Statements

The metadata that accompanies Content shall include a disclaimer statement. The metadata shall be displayed in a manner that it enables an end-user to determine the University’s liability with respect to Content, including information within Content, accessible via MurdochNet.

Disclaimer Notices

The University shall provide an official Copyright & Disclaimer Notice for use with University Content. This notice shall be authorised by the Copyright Coordinator and shall inform end-users of the University’s liability regarding University Content and information within that Content. This Copyright & Disclaimer Notice shall include a link to this Policy.

Liability for Associated Content and Foreign Content may not always be clear. The University shall provide an official Disclaimer Notice for use with Associated Content and Foreign Content. This notice shall be authorised by the Director, Office of Information Technology Services and shall inform end-users of the University’s position with respect to liability for Associated Content or Foreign Content. This Disclaimer Notice shall include a link to this Policy.

Document Information Footers

The metadata that accompanies Content shall include the use of document information footers or metadata popups accessed by a link on a page titled Page Information. The footer or popup display shall include a disclaimer statement.

The disclaimer statement shall:

  • provide a link to the appropriate official University Disclaimer Notice.

Liability for Content Queries

Any queries related to the liability for Content, including information within Content, with respect to State, Territory or Commonwealth laws, should, in the first instance, be addressed to the University’s General Counsel.

Persons in the role of Content Custodian, Web Liaison Officer, or Content Provider, should refer to Section 3.2.3 Inappropriate Content and Section 3.2.4 Non-Compliant Content, for detail on legal constraints and requirements. The preparation or production of Content that may be considered to be Inappropriate Content or Non-Compliant Content, may raise issues of liability for Content.
