Murdoch University (“Murdoch”) offers blogging services subject to the following terms and conditions. By accessing, creating or contributing to any blogs hosted by Murdoch, you agree that:
You must keep your password and username secure. You are responsible for all activity on your account.
You must use the service in accordance with all applicable laws.
Licence:
Unless you specify otherwise, any and all copyright works authored and posted by you to any blog (“Work”) are submitted under the terms of an Attribution ShareAlike 2.5 Australia Creative Commons Public Licence. Under this licence, you permit anyone to copy, distribute, display and perform your Work, royalty free, on the condition that your authorship is credited on each occasion. You also permit others to distribute derivative works of your Work, but only if they do so under the same Attribution ShareAlike Australia licence.
If you prefer to offer your Work on more restrictive terms, you may:
select a different creative commons licence or copyright notice as part of the theme for your blog; or
All content on your blog is syndicated for RSS aggregation unless you change your settings to indicate otherwise. This means that, amongst other things, RSS aggregators may copy, distribute and display such content.
Murdoch has a licence to use, edit, reproduce, reformat, incorporate in a collective work, transmit and distribute any content posted as is necessary to run the service.
You warrant that you will not breach any third party’s intellectual property rights by posting material and granting the licences under clauses 3 and 4. If you do post third party material then you must provide appropriate attribution.
Murdoch makes no warranty as to the availability, reliability and security of the service (or any third party service for which a link is provided), including that any data on the service will be retained, accessible or transmitted.
You will be bound by any modifications made by Murdoch to these terms and conditions. You must regularly review these terms and conditions.
Content is the responsibility of those who post it. Subject to paragraph 11, Murdoch does not monitor or endorse any content, and takes no responsibility for any content. Users must make their own assessment of material posted and Murdoch accepts no responsibility for damage incurred as a result of reliance on any content.
You must not impersonate any other person or (unless authorised to do so as a Murdoch employee) represent that any content posted by you is endorsed by Murdoch.
Murdoch endorses any non academic content on any officially endorsed Murdoch University blog.
In no case does Murdoch warrant that any content on a blog is accurate.
Murdoch may not moderate content prior to publishing and you should therefore use discretion in deciding what to view.
Murdoch may remove any content, or to refuse to accept, distribute or display content, at its absolute discretion.
Murdoch may modify, suspend or terminate the service or your account at any time and for any reason, without liability.
You must not post any material that:
is illegal, objectionable, defamatory, offensive or threatening;
promotes hate towards a group of people based on gender, race, religion, disability or sexual orientation; or
These terms and conditions will be governed by the laws of Western Australia, and the exclusive jurisdiction of the courts of Western Australia and any court that may hear appeals from any of those courts will apply for any proceedings in connection with these terms and conditions.
If any of these terms or conditions is or becomes void, voidable or otherwise invalid or unenforceable, it will be read down so as to be valid and enforceable or, if this is impossible, it will be severed from these terms and conditions so that the remainder of these terms and conditions remain in full force and effect.
